By accessing or using Cardmaker ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Cardmaker is an online service that allows you to create custom greeting cards. You provide a text description, and our Service uses artificial intelligence (OpenAI) to generate a unique card image. The image is then printed on a physical greeting card and shipped to your specified address.

3. AI-Generated Content

Card designs are generated using artificial intelligence. By using the Service, you acknowledge that:

• Each generated image is unique and may vary from expectations
• The printed card may have minor variations from the on-screen preview due to differences between screen displays and physical printing
• AI-generated images may have limited or no copyright protection under current US law, as the US Copyright Office has indicated that purely AI-generated works without sufficient human authorship may not be copyrightable
• You are purchasing a physical printed card, not a license to the underlying digital image

4. Acceptable Use

When using Cardmaker, you agree not to submit prompts that:

• Request content that is illegal, harmful, threatening, abusive, or harassing
• Infringe on any third party's intellectual property rights (e.g., requesting copyrighted characters or trademarked logos)
• Contain or request sexually explicit, violent, or hateful content
• Attempt to generate content depicting real individuals without their consent
• Violate any applicable laws or regulations

We use automated content moderation to screen prompts before image generation. We reserve the right to refuse any order that violates these guidelines.

5. Orders and Payment

• All prices are listed in US Dollars
• Payment is processed securely through Shopify at the time of purchase
• By placing an order, you confirm that the shipping information provided is accurate and complete
• We reserve the right to cancel orders that violate these terms and issue a full refund

6. Shipping and Delivery

Cards are printed and fulfilled by our print-on-demand partner. Typical delivery times are 5-12 business days depending on your location. Risk of loss passes to you upon delivery of the card to the shipping carrier.

8. Intellectual Property

The Cardmaker name, logo, website design, and underlying software are the property of Cardmaker and its licensors. You may not copy, modify, or distribute any part of the Service without our written permission.

9. Third-Party Services

The Service relies on the following third-party providers:

• OpenAI — AI image generation
• Shopify — Payment processing and checkout
• Printify — Card printing and fulfillment

Your use of the Service is also subject to the terms and policies of these providers.

10. Limitation of Liability

To the maximum extent permitted by law, Cardmaker's total liability for any claim arising from your use of the Service is limited to the amount you paid for the specific order giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, error-free, or that generated images will meet your specific expectations.

We may update these Terms from time to time. The updated version will be indicated by the "Last updated" date at the top of this page. Your continued use of the Service after changes constitutes acceptance of the revised terms.
